In-house tax manager responsible for managing all aspects of Cargill’s tax planning, direct and indirect tax compliance, and tax dispute resolution in Malaysia.
Tax planning for acquisitions, joint ventures and dispositions, post-acquisition integration/corporate restructuring,
Primary advisor for Malaysia tax with respect to cross-border trading pattern issues such as transfer pricing, permanent establishment, withholding taxes and tax credits,
Preparation of income tax return and handling tax disputes,
Primary advisor for GST in Malaysia including supervision of the GST compliance process and management of GST disputes,
Handling relationship with Malaysia tax authorities, particularly with tax rulings and tax disputes.
Interpretation and advice on tax legislation.
15% Tax Planning
Responsible for providing pro-active tax advice to Cargill business units and functions with respect to Cargill’s operations in Malaysia. This includes analyzing relevant tax law as it applies to Cargill’s business and doing primary tax research, negotiating with local tax authorities, and reviewing and negotiating legal documents. Responsibilities include identifying tax risks and opportunities related to Cargill’s new investments, acquisitions and joint ventures in Malaysia as well as advising business units on tax aspects of their current operations, providing advice with respect to international transactions (such as implications for withholding tax, transfer pricing, permanent establishment, customs, etc.), providing advice on payroll tax withholding requirements, preparing and communicating written and verbal tax advice, and working with business managers and finance personnel to implement tax planning advice. Existence of tax incentives and developments in this area requires individual to maintain contact with government bodies and be the “face” of Cargill in meetings and presentations at various times.
Provide advice and support on Malaysia GST issues; monitor compliance and credit positions; supervise reporting obligations, coordinate and interface with non-tax personnel handling GST compliance issues, and perform or manage all interaction with the tax authorities.
40% Tax Reporting/Compliance
Responsible for oversight and guidance with respect to Cargill’s tax compliance in Malaysia, including the preparation of Malaysia income tax returns and supervising the preparation of and improving the process for indirect tax returns, working with the finance group and businesses and overseeing the preparation of transfer pricing reports (where required). The end result is to create a process for the efficient, timely and accurate tax return preparation for Cargill’s companies in Malaysia. Responsibility also includes assistance to the US Tax Dept. with respect to their tax reporting (the international tax package) and US tax audits.
20% Tax Audits/Controversy
The individual is responsible for managing Malaysia income tax and indirect tax audits for Cargill as well as tax rulings requests and renewals, working together with the finance group, the Cargill Tax & Customs function and businesses. The end result is to ensure favorable (and measurable) and timely resolution of tax controversies for Cargill’s businesses in Malaysia.
Provide tax education and training and serve as source of tax information for businesses and functions through periodic meetings and training sessions, particularly with respect to GST processes and requirements.
University Degree in Law or Accounting or Commerce or Mathematics, or related. Advanced Degree in Taxation is a plus.
Minimum 7 years of professional corporate tax experience in a national/international law firm, public accounting firm or MNC. Prior work experience in MNC with multiple business lines and tax incentives.
Demonstrated knowledge of Malaysian direct and indirect tax laws, and international tax treaties.
Experience in dealing with government bodies.
Knowledge of current trends in assessing practice and ability to assess level of tax risk.
Excellent written and verbal English communications skills along with ability to read Bahasa.
Able to handle substantive tax issues on day-to-day compliance tasks without regular direction and support and advise on tax issues related to routine Cargill transactions in their practice area with some supervision.
Able to lead and motivate local staff who are not formally part of the Global Tax & Customs function to meet tax filing deadlines and implement process changes as necessary.
Able to demonstrate good judgment and pro-activity to involve other members of the Global Tax & Customs team as required.
Excellent interpersonal skills. Ability to work in large, decentralized interfunctional teams with minimal supervision.

Ability to prioritize responsibilities and work independently.
